Artificial intelligence (AI) is no longer a futuristic concept; it’s here, and it’s reshaping industries across the globe. From improving productivity to enhancing public safety, AI is proving to be a powerful tool. However, not everyone is on board with its rapid integration. Some industries are pushing back, and leaders are grappling with how to balance the benefits of AI with its potential risks.

AI in Critical Infrastructure: A Double-Edged Sword

Jen Easterly, Director of the U.S. Cybersecurity and Infrastructure Security Agency, highlighted the growing use of AI in critical sectors such as water, healthcare, transportation, and communication. While these advancements are promising, Easterly emphasized the importance of implementing AI responsibly to avoid introducing new risks.

“We are looking at critical infrastructure owners and operators, businesses from water and healthcare and transportation and communication, some of which are starting to integrate some of these AI capabilities,” Easterly said. “We want to make sure that they’re integrating them in a way where they are not introducing a lot of new risk.”

Regulatory Challenges: A Global Concern

A recent survey by consulting firm Deloitte revealed that uncertainty over government regulations is a significant barrier to AI adoption. Among business leaders surveyed worldwide, 36% cited regulatory compliance as the top challenge, followed by difficulty managing risks (30%) and the lack of a governance model (29%).

Easterly acknowledged the government’s slow pace in regulating AI but stressed the need for safeguards. “These are going to be the most powerful technologies of our century, probably more,” she said. “Most of these technologies are being built by private companies that are incentivized to provide returns for their shareholders. So we do need to ensure that government has a role in establishing safeguards to ensure that these technologies are being built in a way that prioritizes security.”

State-Level Action: Protecting Intellectual Property

While Congress has debated overarching protections for AI, state governments have taken the lead in enacting rules. Tennessee, for instance, passed the Ensuring Likeness Voice and Image Security Act, or ELVIS Act, which classifies vocal likeness as a property right. This makes Tennessee the first state to protect singers from unauthorized AI-generated imitations. Illinois and California have since followed suit with similar laws.

Country artist Lainey Wilson, a vocal advocate for these protections, testified during a congressional hearing on AI and intellectual property. “Our voices and likenesses are indelible parts of us that have enabled us to showcase our talents and grow our audiences, not mere digital kibble for a machine to duplicate without consent,” Wilson said.

Cracking Down on Deceptive AI Practices

The Federal Trade Commission (FTC) has also stepped in to address unethical AI practices. In September, the FTC launched “Operation AI Comply,” targeting deceptive business practices such as fake reviews generated by chatbots.

Despite these challenges, Easterly remains optimistic about AI’s potential. “I am a technologist at heart, and I am an optimist at heart. And so I am incredibly excited about some of these capabilities,” she said. “I do want to make sure that this technology is designed and developed and tested and delivered in a way to ensure that security is prioritized.”

AI in Healthcare: A Game-Changer

AI is making waves in healthcare, with promising results. Hawaii recently approved a law to invest in AI research for medical applications. A study comparing OpenAI’s chatbot to doctors found that the chatbot outperformed human physicians in diagnosing medical conditions, achieving over 90% accuracy compared to the doctors’ 75%.

Beyond diagnostics, AI is also aiding in disaster response. Following the devastating wildfires in Maui, Hawaii allocated funds to the University of Hawaii to develop AI-driven platforms for wildfire risk mapping and forecasting. Hawaiian Electric is deploying high-resolution cameras to enhance fire detection capabilities.

AI in Education: Enhancing Safety

AI is also being used to improve safety in schools. Several districts across the U.S. have implemented firearm detection systems. In Utah, for example, an AI system notifies officials within seconds if a gun is detected on campus.

“We want to create an inviting, educational environment that’s secure. But we don’t want the security to impact the education,” said Michael Tanner, CEO of Park City, Utah, School District.

Maryland and Massachusetts are considering similar measures, with both states establishing commissions to study emerging firearm technologies. These commissions will evaluate the risks and benefits of implementing AI-based security systems in schools.

Global Perspectives: The European Union’s Approach

While the U.S. is still navigating its approach to AI regulation, the European Union has already implemented comprehensive rules. The EU classifies AI risks into categories ranging from minimal to unacceptable. For example:

  • Minimal risk: No regulations required.
  • High risk: Strict compliance requirements for critical infrastructure software.
  • Unacceptable risk: Banned technologies, such as those that profile individuals or use public images to build databases.

Chatbots in the EU must inform users that they are interacting with a machine, ensuring transparency.

The Road Ahead for AI in the U.S.

Experts believe the U.S. will not adopt regulations as stringent as the EU’s. However, Easterly emphasized the importance of staying ahead in the AI race. “We need to stay ahead in America to ensure that we win this race for artificial intelligence,” she said. “It takes the investment, it takes the innovation. We have to be an engine of innovation that makes America the greatest economy on the face of the earth.”

As AI continues to evolve, its impact on industries, safety, and society will undoubtedly grow. The challenge lies in harnessing its potential while mitigating its risks—a balancing act that will shape the future of technology and humanity.
